TYLER - After a motor vehicle wreck in Lindale, an Alabama resident has filed a lawsuit against the other driver, claiming she failed to yield the right of way when crossing three lanes of traffic.
Crystal Lassiter filed suit against Vicki Denise Kay and her insurer, Allstate Property and Casualty Insurance Co., on Sept. 9 in the Eastern District of Texas, Tyler Division.
The lawsuit concerns a vehicle crash that occurred on Sept. 15, 2011. According to the lawsuit, Lassiter was traveling northbound on S. Main Street in Lindale and was in the inside lane when Kay allegedly pulled out of a private drive and crashed into Lassiter’s vehicle.
The defendant is accused of failing to be attentive, failing to yield the right of way from the private drive, crossing three traffic lanes and colliding with Lassiter’s vehicle.
The defendant is also accused of negligence for:
• Failing to keep a proper lookout;
• Failing to timely apply the brakes of her vehicle in order to avoid the collision;
• Driving a vehicle at a rate of speed which was greater than that which an ordinarily prudent person would have driven under the same or similar circumstances;
• Failing to obey traffic control devices;
• Failing to yield the right-of-way;
• Failing to maintain her vehicle under control; and
• Failing to proper evasive action.
The plaintiff is seeking an award of damages for medical expenses, lost wages, physical pain, mental anguish, impairment, disfigurement, interest and court costs.

U.S. District Judge Michael H. Schneider is assigned to the case.
