Motorcyclist claims driver failed to yield

A man has filed suit against the driver who he claims pulled in front of his motorcycle, causing a collision. 

Joseph Leger claims he was driving a 2001 Harley Davidson motorcycle west in the 300 block of Interstate 10 East when defendant Francisco Perez suddenly switched lanes and pulled directly in front of Leger, causing a collision.

Because of the accident, Leger suffered physical pain and mental anguish, endured physical impairment and incurred medical costs, according to the complaint filed Sept. 3 in Jefferson County District Court.

Perez negligently failed to maintain proper control of his vehicle, failed to keep a proper lookout, disregarded the rights of other drivers, failed to change lanes when it was safe to do so and failed to keep a safe distance between his vehicle and Leger’s, the suit states.

In his complaint, Leger is seeking actual damages within the jurisdictional limits of Jefferson County District Court, plus exemplary damages, pre- and post-judgment interest, costs and other relief the court deems just.

Charlton P. Hornsby of Beaumont will be representing him.

The case has been assigned to Judge Bob Wortham, 58th District Court.
