A New Orleans trucker has filed a lawsuit against another truck driver claiming the driver was negligent for crashing into the back of his 18-wheeler.
Michael Hills filed suit against Stevens Transport Inc. and Randy Carl Bennett on Sept. 11 in the Eastern District of Texas, Beaumont Division.
The accident occurred on Nov. 22, 2012, as Hills was driving his 18-wheeler, traveling east on Interstate 10. Defendant Bennett was also driving an 18-wheeler and traveling east on IH 10. Both drivers approached an area where there had been a previous accident and Hills slowed down and came to a stop. After Hills stopped, Bennett crashed into the back of Hill’s vehicle, according to the lawsuit.
The defendants are accused of negligence for failing to keep a proper lookout for Hills, failing to maintain control of his vehicle, failing to stop in a timely manner to avoid colliding with Hills’ vehicle, failing to take appropriate evasive measures, failing to apply his brakes in a timely fashion so as to avoid the collision with Hills’ vehicle and failing to drive in a manner that was appropriate for the conditions at the time.
The plaintiff is seeking an award of damages for medical expenses, physical pain and suffering, physical impairment, permanent scarring and disfigurement, damage to his vehicle, loss of earnings, interest and court costs.
Hills is represented by Jim Wyly and Sean Rommel of Wyly Rommel in Texarkana. A jury trial is requested.
