Discovery begins in motorcycle rider’s injury suit

Discovery has begun in litigation brought by Port Neches local Nicholas Taylor, who sued Robert Fong, a Port Arthur resident, alleging Fong struck him while he was out riding his motorcycle.

As previously reported, the suit was filed April 2 in Jefferson County District Court. 

Court records a certificate of discovery was filed Aug. 27, showing the defendant’s responses to request for disclosure and production.

According to the lawsuit, on March 14, 2013, Taylor was out driving his motorcycle at the intersection of Nail Street and South Avenue in Port Neches when Fong, who was stopped at a stop sign, failed to yield the right of way and struck him.

The suit further accuses Fong of negligently failing to keep a proper lookout.

On top of exemplary damages, the plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.

Attorney Hart Green of the Beaumont law firm Weller, Green, Toups & Terrell represents the plaintiff.

Houston attorney John Kilpatrick of Kilpatrick, White & Deas represents the defendant.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
