Wal-Mart settles slip-and-fall suit

Wal-Mart Stores Texas has settled a suit brought by Port Neches local Kandy Clark, who alleged she slipped and fell in a puddle of water leaking from a Wal-Mart roof.

As previously reported, the suit was filed March 27 in Jefferson County District Court. 

Court records show that on Aug. 2 a final judgment was entered, stating that the parties announced to the court that the cause had been compromised and settled.

According to the lawsuit, on May 7, 2012, Clark was at the Port Arthur Wal-Mart when she slipped in a puddle of water.

“The water appeared to be leaking from the roof and there were no warning signs in the area,” the suit states.

The suit alleged Wal-Mart owed the general public a duty to warn and safeguard them from dangerous conditions on its premises.

Clark was suing for her alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.

Attorney Tom Oxford of the Beaumont law firm Waldman Smallwood represents her.

Judge Bob Wortham, 58th District Court, is assigned to the case.
