Bank seeks money from woman after she crashes vehicle used as collateral

A bank has filed suit against the woman who it claims crashed a car that was supposed to be used as collateral to pay off her recently deceased brother’s loan.

Community Bank of Texas claims Kristina Catherine Swink got into an accident with her brother’s 2012 Nissan Juke on July 28. The vehicle was supposed to be collateral for money Jason Richard had borrowed from the bank on Feb. 3, 2012, according to the complaint filed Sept. 5 in Jefferson County District Court.

Swink did not have authorization to be driving the vehicle following her brother’s death, and the bank had asked for its return, the suit states.

Now, the bank is requesting Swink pay actual damages within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs, attorney’s fees, punitive penalties and other relief the court deems just.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
