Rain caused truck to hydroplane into ditch, lawsuit says

GALVESTON - Claiming a ride in a pickup truck two years ago resulted in an accident which "permanently disabled" him, Santa Fe local Rick Strader has filed a lawsuit.

Court documents filed Sept. 18 in Galveston County District Court blame motorist William Tittle, a Dickinson resident, for the Sept. 18, 2011, event in question.

Both men were traveling in the Dodge pickup truck on FM 646 at the time of the incident.

Strader recalls rain falling that day, alleging it caused Tittle to lose control of the vehicle.

According to the original petition, the Dodge hydroplaned and then ran into a ditch.

"Once hitting the ditch, the Dodge pickup truck rolled end over end," the suit says.

The passenger required "serious" medical treatment following the wreck.

He blames Tittle for:


  • Failed to keep a proper lookout;

  • Failed to apply the brakes; and

  • Failing to control his rate of speed.


Meanwhile, Mary Custer, also of Santa Fe, is being sued because it was her truck driven by Tittle.

Consequently, Strader seeks unspecified monetary damages.

Attorney Michael L. Aldous of Santa Fe is representing the claimant, and Galveston County 405th District Court Judge Michelle Slaughter is presiding over the case.
