Lawsuit claims numerous collection calls forced man to change cell phone number

TEXARKANA - A Hooks resident has filed a lawsuit against a debt collector claiming that he received so many collection calls that he was forced to change his cell phone number.

John Jeko filed suit against Portfolio Recovery Associates on Sept. 27 in the Eastern District of Texas, Texarkana Division. 

According to the lawsuit, between October 2012 and February 2013, the defendant placed repetitive and continuous calls to Jeko at his home and cell phones. Jeko alleges that he asked the defendant to stop the telephone calls but the defendant responded to his requests by threatening him.

“Defendant called Plaintiff with such frequency that Plaintiff had to change his cellular telephone number,” the lawsuit states.

The defendant is accused of violating the Fair Debt Collection Practices Act and the Texas Fair Debt Collection Practices Act by repeatedly calling Jeko with the intent to annoy and harass.

The plaintiff is seeking an award of actual and statutory damages, attorney’s fees and court costs.

Jeko is represented by Amy L. Bennecoff in Ambler, Penn.

A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
