GALVESTON - Harris County resident Shams Siddiqui is suing Dickinson local Sharon Crews Garza in response to a two-vehicle accident last year in the defendant's city, recent court documents say.

A lawsuit filed Oct. 3 in Galveston County District Court alleges Garza's vehicle struck that which carried Siddiqui near Country Club Drive and FM 517 on Sept. 12, 2012.

According to Siddiqui, the defendant, who was traveling northbound on Country Club, failed to stop at a posted stop sign and caused the collision.

"The collision was with such force that the defendant's vehicle traveled another 165 feet before it came to a stop," the original petition says.

It insists the claimant did not to bring the accident in question forth, asserting Garza suffered from seizures and blackouts but still went behind the wheel.

The respondent is blamed for:

  • Failing to yield the right of way to the plaintiff's vehicle;

  • Failing to keep a lookout;

  • Failing to make timely and proper application of the brakes;

  • Failing to control her vehicle; and

  • Failing to take proper evasive action to avoid the collision.

Consequently, Siddiqui seeks more than $50,000 in damages and a jury trial.

The case has been assigned to Galveston County 122nd District Court Judge John Ellisor.
