Motorcyclist says Conroe man caused Galveston wreck

GALVESTON - A motorcyclist has filed a lawsuit following a two-vehicle accident in Galveston last year, according to recent court documents.

In the suit filed Oct. 15 in Galveston County Court at Law No. 1, Jay Knoth alleges that a vehicle driven by Conroe resident Ronald D. Rodriguez struck him at the intersection of Seawall Boulevard and 59th Street on July 28, 2012.

Prior to the subject event, according to the original petition, the plaintiff came to a complete stop at a traffic signal at the specified intersection.

Meanwhile, Rodriguez was traveling directly behind Knoth and "failed to control his speed, violently striking the plaintiff's motorcycle from behind," the suit says.

It additionally faults the motorist for:


  • Failing to keep a proper lookout;

  • Failing to timely apply brakes;

  • Failing to maintain an assured clear distance between himself and the complainant;

  • Failing to maneuver the vehicle to avoid the collision;

  • Failing to control the vehicle; and

  • Failing to avoid the accident.


Galveston local Larry M. Herrington is also being sued since the vehicle which allegedly caused the wreck belonged to him.

Consequently, Knoth seeks no more than $100,000 in damages and a jury trial.

He is represented by attorney Joseph D. Terry of Terry & Thweatt, P.C. in Houston.

The litigation has been assigned to Galveston County Court-at-Law No. 1 Judge John Grady.
