GALVESTON - An apparent dispute over property in Dickinson recently yielded a lawsuit.
Jeffrey Campbell is suing Sheryl Malek in an effort to retrieve the title to subject property, having initiated legal action in Galveston County District Court on Oct. 22.
Campbell and Malek had a written agreement which called for the defendant to sell the property in exchange for $200,000.
Court papers explain that the closing was scheduled to occur earlier this month, but the respondent "has failed and refused to close."
Insisting he fulfilled his contractual obligations, the claimant adds he subsequently demanded Malek honor her part of their agreement and proceed with the closing to no avail.
"All of the conditions precedent that established the plaintiff's right to the defendant's performance were fulfilled at the time the plaintiff demanded that the defendant complete the contract," the original petition says.
According to the suit, Campbell's financial losses as a result of Malek's supposed failure to perform equal "at least" $250,000.
A jury trial is requested.
He is represented by attorney David L. Thornton of The Law Offices of David L. Thornton in Friendswood.
The case has been assigned to Galveston County 212th District Court Judge Susan Criss.
