Maria A. Rossell filed suit in the District Court of Jefferson County on Oct. 28, naming Liberty Plantation LLC, doing business as Eagle Falls, LBP Properties LLC, doing business as Aikin Land and Cattle, Thomas Aikin, Carol Aikin and Ryan Aikin as the defendants.
Rossell is suing the defendants for fraud and breach of contract.
According to Rossell, she bought a piece of land from the defendants who are developers. Rossell allegedly bought the land in October 2011 for $174,900.
Rossell claims the land was part of a subdivision called Eagle Falls which had been promoted as premier new development. Rossell claims the purchase contract included a fact sheet with a list of amenities the defendants said they would build in the subdivision by December 2010.
Among these purported amenities were a swimming pool, basketball court, covered boat slips and a club house. Now Rossell is suing alleging the defendants have not built the amenities they promised, thus breaching the contract.
Rossell is seeking a rescission of the contract, more than $100,000 in damages for the costs associated with purchasing and owning the property.
