SHERMAN - Two Plano caregivers have filed a lawsuit against their former employer, claiming they were not properly paid for their time worked. 

Nichole Kuball and Jennifer Lees filed suit against 4 Corners Residential Services and Roderick Horton on Nov. 20 in the Eastern District of Texas, Sherman Division.

Kuball worked for the defendants as a caregiver from February to September 2013 and Lees worked as a caregiver from March to May 2013.

The caregivers claim that during one or more weeks of employment, the defendants intentionally failed to pay the federally mandated minimum wage for each hour worked during the workweek.  The plaintiffs also claim that they worked more than 40 hours during one or more weeks of their employment and were not paid overtime hours.

The defendants are accused of violating the Fair Labor Standards Act, which prohibits the denial of minimum wage compensation for all hours worked in a workweek and the denial of overtime compensation for hours worked in excess of 40 per workweek.

The lawsuit is seeking an award of damages for minimum wage and overtime compensation, attorney’s fees, interest and court costs.

The plaintiffs are represented by Charles L. Scalise, Vijay A. Pattisapu and Daniel B. Ross of Ross Law Group P.C. in DeSoto. A jury trial is requested.
