Synflex Insulations sues USA Technologies alleging breach of contract

Synflex Insulations LLC filed a lawsuit Nov. 15 in the District Court of Jefferson County against USA Technologies Inc., citing breach of contract and construction trust fund.

The plaintiff states it is seeking payment from the defendant after providing insulation and contracting services. The defendant has made partial payment to the plaintiff, but refuses to pay the total amount due, which constitutes breach of contract and a violation of the construction trust fund doctrine, according to the complaint. 

The plaintiff is seeking actual damages, consequential damages, interest, attorney's fees and costs.

Synflex Insulations LLC is represented in the case by James E. Wimberley of McPherson, Hughes, Bradley, Wimberley, Steele & Chatelain.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
