GALVESTON - Friendswood locals Russell and Melissa Burkett claim an 8-year-old mechanic's lien on their residence is improper and invalid.
In response to the lien in question, the Burketts are suing Curtis and Deborah Turner, doing business as C Turner Electric Co.
Recent court papers filed Dec. 13 in Galveston County District Court show the plaintiffs retained a general contractor to perform services at their home in 2005.
According to the lawsuit, the Turners maintain they performed work and supplied materials from June to July 2005 to which the Burketts assert no written contract existed.
About three months later, the defendants reportedly filed the aforementioned lien in the amount of $4,730.35 against the Burkett home.
"The plaintiffs have no record that the defendants sent all of the requisite notices to both of them as owners of the real property, or that the defendants complied with the statutory process to perfect their alleged lien against the plaintiff's residence," the suit says.
It adds the Turners "have not brought suit to enforce their alleged lien claim" in almost a decade.
Attorney Daniel F. Castaneda of Buckley, White, Castaneda & Howell L.L.P. in Houston is representing the complainants, and Galveston County 405th District Court Judge Michelle Slaughter is presiding over the case.
