Harris Co. woman takes League City motorist to court over New Year's Day 2012 auto-pedestrian collision

GALVESTON - A Harris County woman has brought a lawsuit against a League City motorist she claims struck her nearly two years ago in the parking lot of a Mexican restaurant, recent court papers say.

Wanda Terry Giancaterino blames the New Year's Day 2012 auto-pedestrian accident on Lacy Alyse Lehrmann in the suit filed Dec. 17 in Galveston County District Court.

Giancaterino was leaving Mely's Mexican Restaurant prior to the subject event.

According to the original petition, the plaintiff was making her way through the parking lot with other pedestrians.

Meanwhile, Lehrmann "suddenly and without warning backed out of a parking space at a high rate of speed and struck the plaintiff with the defendant's vehicle," it says.

The suit asserts that Giancaterino "was thrown to the ground" and "was injured."

She faults the defendant for:


  • Failing to keep a proper lookout;

  • Failing to brake;

  • Failing to control her speed; and

  • Failing to steer as to avoid the wreck.


Consequently, the complainant seeks unspecified monetary damages.

Attorney Eric D. Nielsen of Nielsen & Mukerji LLP in Houston is representing Giancaterino, and the case has been assigned to the Galveston County 212th District Court.
