Woman struck by tumbling boxes sues Kroger

Alleging she was struck by tumbling boxes while reaching for yogurt, Catherine Zoch has filed suit against an area grocery store.

Zoch filed suit Dec. 19 in Jefferson County District Court against Kroger Texas and store manager Alice Trahan. Huey Zoch is also a plaintiff in the litigation. 

According to the lawsuit, on April 15, Catherine was shopping at a Beaumont Kroger. She claims that while she was leaning over a dairy display to get some yogurt, when she was struck by several large, heavy boxes that she alleges had been stacked improperly on a cart.

The Kroger employee pushing the cart attempted to turn the cart incorrectly, causing the boxes to become unstable and fall, according to the suit.

The suit accuses the defendants of negligently failing to train and supervise their employees and failing to train them on the proper procedure to stack a cart.

Catherine is suing for her alleged past and future medical expenses, mental anguish, pain and impairment.

Her husband is suing for loss of consortium.

They are represented by Beaumont attorney Michael Ramsey of the Mostyn Law Firm.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
