The defendant in a personal injury case is asking a federal court to take over the Texas case because the parties are from two different states and the requested damages exceeds state limits.

Dennis C. Egburtson filed a notice of removal Jan. 8 with the United States District Court for the Eastern District of Texas-Marshall Division. The notice seeks to remove the case filed against Egburtson by Johnnie Adams from the Harrison County Circuit Court to the federal court. 

The notice states Adams, a Harrison County resident, filed the original petition Dec. 4, against Egburtson, a resident of Randolph County, N.C. Adams’s original complaint is seeking to recover personal injury damages to be paid to a personal injury claimant, according to the notice.

Adams is seeking damages in excess of $200,000 and court costs. Egburtson is being represented by Clay White of White and Shaver.
