SHERMAN - Kelly Coder filed suit in the U.S. District Court for the Eastern District of Texas-Sherman Division on Jan. 6, naming Medicus Laboratories LLC as the sole defendant.
Coder, of Grayson County, is accusing Medicus of firing her in violation of the Americans with Disabilities Act. Coder was allegedly employed by Medicus from August 2011 until her discharge in October 2012. Coder claims she went to her doctor's appointment on Sept. 22, 2012, to be evaluated for surgery of her cervical spine. Upon examination, Coder claims she was sent to another hospital in Port Arthur to undergo surgery, and in the process missed more than seven days of work.
On Oct. 1, 2012, Coder says she returned to work and asked for Family and Medical Leave Act paperwork in anticipation of undergoing another surgery. On Oct. 2, 2012, Coder was allegedly terminated and Medicus did not give her a reason. Coder is now suing, accusing Medicus of discharging her in violation of the ADA.
Coder is seeking an undisclosed amount in damages and is being represented by attorney Ronald R. Huff.
The case has been assigned to District Judge Richard Schell and referred to Magistrate Judge Don Bush.
