Banks ask to move foreclosure case to federal court

A securities backer and a bank are asking the court to remove the case from state to federal court.

The notice of removal of defendants Wells Fargo Bank N.A. and U.S. Bank N. A., as trustee for master asset backed securities trust 2006-NCI, asks to remove the lawsuit from the 21st Judicial District of Smith County Texas to the U.S. Court for the Eastern District of Texas Tyler Division, according to the Jan. 13 document. 

Tonda Helms filed a verified original petition, a temporary restraining order and request for disclosure against Wells Fargo and the U.S. Bank on Jan. 3, the notice said. The original petition involved the foreclosure of her property in Tyler.

The banks are being represented by Robert Mowrey, Jason Sanders and Johnathan Collins of Locke Lord LLP in Dallas.
