A bank is suing, seeking an amount due on a loan the defendant has failed to pay.
CommunityBank of Texas N.A. filed a lawsuit Feb. 4 in the Jefferson County District Court against Bobby Sanders, citing breach of contract.
According to the complaint, CommunityBank executed a contract with Quality Medical Equipment & Supply LLC, where Sanders is a managing member.
The complaint states Sanders signed a personal guarantee to pay the Promissory Note if Quality defaulted. After the plaintiff complied with the agreement, Quality defaulted in paying the debt and Sanders also failed to comply with his personal guarantee agreement, according to the suit.
The bank says it has accelerated the debt according to the terms of the agreement and there is a current principal sum due of $318,680, plus interest in the amount of $19,970.19, and late fees in the amount of $4,913, totaling $343,563.79. The complaint states the defendant also owes repossession and attorney's fees in the amount of $46,322.53.
CoummunityBank is seeking a judgment in the amount of $389,866.32, plus interest and fees.
