Hit-and-run victims sue insurance company to collect benefits

Nederland residents are suing, seeking insurance benefits allegedly owed after a hit-and-run car accident. 


Delfino Benavidez and Joana Benavidez filed a petition and request for disclosure, document production, admissions and interrogatories on Feb. 10 in the Jefferson County District Court against Texas Farm Bureau Mutual Insurance Co., doing business as Texas Farm Bureau.

The plaintiffs claim on Feb. 13, 2012, they were involved in a hit-and-run motor vehicle collision in the 3900 block of 39th Street and the 4200 block of Memorial Boulevard/Highway 69 in Port Arthur.

The suit alleges the hit-and-run motorist collided with the plaintiffs, causing injuries and damages.

At the time of the accident, the plaintiffs were covered under the defendant's insurance and to date the defendant has failed to pay the plaintiffs' uninsured motorist coverage, personal injury protection and/or Med Pay benefits as provided under the plaintiffs' policy, according to the complaint.

Delfino Benavidez and Joana Benavidez are seeking an undisclosed amount in damages.

They are being represented in the case by Jeremy W. McKey of McKey, Morrison & Sanchez PC and Joe Williams of The Law Office of Joe M. Williams & Associates.
