A company is suing, seeking to have a sales contract voided.

ODC LP, a diagnostic imaging center in Beaumont, filed a class action lawsuit Feb. 21 in the Jefferson County District Court against Medical Imaging Solutions Group Inc. of Texas. 

According to the complaint, on Oct. 21, 2011, the parties entered into a set of three sales contracts for a refurbished CT Scanner, MRI and X-ray machine, with a total purchase price of $1,501,307. The complaint states the purchase price of the equipment included a 60 month full service agreement totaling $1,211,974.80.

According to the complaint, the equipment was delivered and installed at ODC's facility in Beaumont by the defendant in December 2011. The complaint alleges that since installation, the equipment had mechanical failures and the defendant made numerous attempts to make repairs.

According to the complaint, the defendant filed a lawsuit against the plaintiff, and others, for failure to make payments pursuant to the Service Agreement, claiming the plaintiff was in default on the contract.

According to the complaint, the defendant sold radiological equipment and services without authorization by the Texas Department of State Health Services. The plaintiff is claiming that the contract and the defendant's complaint are void due to illegality.

The plaintiff is asking the court to void the sales contract and service agreement, among other relief.
