Dallas area bar sued for performances of copyrighted music

A group of copyright holders is suing over claims an establishment in The Colony illegally performed copyrighted music. 


Broadcast Music Inc.(BMI), House of Cash Inc., Moebetoblame Music, Mad Dog Winston Music Ltd., Warner-Tamerlane Publishing Corp., Average Joe's Entertainment Group LLC, doing business as Average ZJ's Music Publishing, and Indiana Angel Music filed a lawsuit March 28 in the Sherman Division of the Eastern District of Texas against C.D.J.M. Inc., doing business as C.J.'s Restaurant and Club, Sidney F. Cade and Richard B. Ponder, citing copyright infringement.

According to the complaint, C.J.'s on Main Street in The Colony publicly performed musical compositions copyrighted by the plaintiffs.

The suit states that BMI has been granted the right to license the public performance rights in approximately 7.5 million copyrighted musical compositions including those which are alleged herein to have been infringed.

"Plaintiffs allege four claims of willful copyright infringement, based upon Defendants' unauthorized public performance of musical compositions from the BMI Repertoire," the complaint states.

Court papers show the four claims to be over "Folsom Prison Blues" by Johnny Cash, "Under the Bridge" by the Red Hot Chili Peppers, "Glycerine" by Bush and "Dirt Road Anthem" by Jason Aldean.

The plaintiffs are seeking statutory damages and costs.

They are being represented in the case by attorneys Dan D. Davison and Gita Srivastava of Fulbright & Jaworski LLP.
