Couple sues over square footage numbers

A couple is suing those involved in the purchase of their home because it is smaller in square footage than what they were told. 


Laurie and Carl Schreier filed a lawsuit March 20 in the Jefferson County District Court against Jerry Hughes Realty Inc., Tredway & Company L.L.C., Deborah Hughes and Garland Tredway, citing violations in the Texas Deceptive Trade Practices Act, negligent representation, breach of contract and liability. 

The Schreiers bought a house in 2009 with Deborah Hughes as the realtor and through Jerry Hughes Realty when they incurred a job transfer. The home was represented to be 3,297 square feet with Tredway giving an estimate of $350,000 in market value.

The couple applied for a home equity line in November 2013 and a new appraisal revealed the home was only 2,493 square feet, amounting to a loss in property value including $80,000 in loss for the miscalculated 800 feet.

The couple is suing for $80,000, treble damages, statutory interest and court costs.

They are being represented by John Pat Parsons of Lindsay, Lindsay & Parsons.
