A couple is suing a lube shop claiming their car's engine was damaged by a botched oil change and had to be replaced.
Leah Brockman and Michael Eudy filed a lawsuit March 19 in the Galveston County Court against Express Automotive Group Inc., doing business as Havoline Xpress Lube, citing negligence, breach of warranty and violation of the Deceptive Trade Practices Act.
The lawsuit states the couple took their 2012 Hyundai accent into the Xpress shop on May 5, for a full service oil change.
According to the complaint, the car's engine oil light came on in June and the couple stopped using the vehicle. The car was towed to Ron Carter Hyundai and technicians said the oil leak was coming from the oil filter gasket, the complaint said.
The couple alleges that technicians at the dealership told them the oil filter wasn’t property installed and had caused severe engine damage, the complaint said. The engine had to be replaced, the suit states.
The couple is suing for actual damages of $6,706 to replace the engine and rent a car, treble damages and attorneys fees of at least $5,000.
