Woman claims florist won't return money after daughter's wedding cancelled

A Harris County woman's suit claims a local florist refused to return the down payment for a cancelled order.


Sheila Harrison filed a lawsuit April 15 in the Galveston Division of the Southern District of Texas against D A Tencil Inc., doing business as Haute Flowers and Finds, in League City, citing Texas Theft Liability Act and Consumer Protection Act. 

Harrison claims she entered into an agreement with the defendant on Feb. 8, 2013, for a floral arrangement for her daughter's wedding scheduled for Nov. 9, 2013. According to the suit, Harrison paid a total of $4,273.75 in advance payments to the defendant.

According to the suit, the groom called off the wedding two months before the wedding date. Harrison claims she contacted the defendant to have her down payment returned, but the defendant has failed to respond or return Harrison's funds.

Harrison is seeking damages, interest, attorneys' fees and court costs.

She is being represented by attorneys Richard Melamed and Jarett T. Laochelle of Richard Melamed PLLC in Houston.
