Mother sues Wal-Mart after colliding with driver who bought new tires

A mother is suing for injuries to herself and her two children after another driver collided with them after buying tires at Wal-Mart.


Nicole Hinson, for herself and next friend of Cayden and Cameron Hinson, filed a lawsuit April 3 in the Marshall Division of the Eastern District of Texas against Wal-Mart Stores Inc., citing negligence and gross negligence.



The lawsuit states Stacey Tilley of Hawkins took her 2004 Chevrolet Suburban to the Wal-Mart Tire & Lube Express in Mineola on April 5, 2013, and those working on the car put two new tires on the car. Tilley could not afford four tires and service technicians made the decision to put the two new tires on the front, leaving the old tires on the back, the complaint states.


Tilley was driving on May 15 on Highway 80 near Big Sandy in light rain when the rear tires lost traction and she hyrdroplaned, crashing into Hinson’s vehicle going east.


Cayden Hinson, 2, sustained injuries to his spinal cord and is partially paralyzed and Cameron Hinson and Nicole Hinson also were injured, according to the complaint.


The complaint states service technicians didn’t follow standards when they placed the tires on the front instead of placing new tires on the back and moving the old tires to the front.


Hinson is seeking damages in excess of $75,000.


She is being represented by Jeffery Embry of Hossley & Embry.
