Dallas handicapped man sues restaurant over accessibility

A Dallas man is suing over claims a Wendy's restaurant was not handicap accessible.


Lee Burrell filed a lawsuit April 16 in the Tyler Division of the Eastern District of Texas against Wenone Inc., citing discrimination and negligence. 


Burrell claims he wanted to eat at a Wendy's restaurant at 421 W. Front St. in Tyler, when he discovered it was not handicap accessible. According to the brief, Burrell is handicapped and uses a wheelchair for mobility. When he went to the restaurant he claims he discovered several barriers that made it difficult for him to maneuver around.


The suit alleges the handicap accessible curb's slope exceeded 2 percent, the bathroom door was too narrow for Burrell to get through and there was no accessible route to the front door from the sidewalk.


These barriers are in violation of the Americans with Disabilities Act that requires businesses not to discriminate against individuals with disabilities.


Burrell is requesting the restaurant make modifications to be in compliance with federal law, an order for the restaurant to stop discriminating, attorney's fees and court costs.


He is being represented in the case by Addison attorney Palmer D. Bailey of Law Office of Palmer Bailey.
