Breach of contract

A Texas man is suing over claims the balance of the cancellation of a business he purchased is overdue.

Steven C. Fowler filed a lawsuit May 6 in the Galveston County District Court against Donnie Yarbrough, citing breach of contract.

According to the complaint, Fowler purchased Yarbrough's business, Dr. Fast Fix LLC, is a professional lawn sprinkler service and drainage contractor serving the Houston area, for $30,000 on Dec. 16, 2012. But Fowler says when he attempted to terminate the employment of Yarbrough's brother, who was retained as operations manager, for insubordination, Yarbrough instead offered to buy the business back.

The lawsuit states the two parties entered into a purchase cancellation on Feb. 9, 2013, when the defendant agreed to pay back the initial price plus operating costs for a total of $31,700. The complaint states only $10,000 has been paid and the rest is overdue.

Fowler is seeking the $21,700 owed, plus interest and attorney's fees. He is appearing pro se.
