C & H Arms sued for trademark infringement

AR15.com is suing a firearms business for using a confusingly similar trademark and stealing business.


AR15.com LLC filed a lawsuit May 29 in the United States District Court of the Southern District of Texas Houston Division against Chris Butts, doing business as C & H Arms, citing unfair competition, federal trademark infringement and dilution. 


The plaintiff claims it began using a bolt face logo in connection with the products it sells as early as Oct. 30, 2006. The suit alleges the defendant began using a trademark for their company that was very similar to that of AR15.com and the defendant was selling similar products.


According to the suit, the defendants have refused to change their logo even after the plaintiff confronted Butts about it.


The plaintiff is seeking damages, defendant's profits, attorney's fees and court costs.


It is being represented by Houston attorney Tim Headley.
