A woman claims she suffered various injuries after a driver failed to yield the right-of-way and struck her vehicle.

Leonisha Mack filed a lawsuit July 28 in the Galveston County District Court against Dustan Pena. 

In her complaint, Mack claims she was driving west in the 1400 block of Church Street when Pena suddenly failed to control his speed and yield the right-of-way and struck her vehicle.

Because of the incident, Mack suffered physical pain and mental anguish, incurred medical costs and sustained physical impairment, according to the complaint. They also endured physical pain and suffering, endured physical disfigurement and lost wages, the suit states.

Mack blames Pena for causing the collision, saying he negligently failed to keep a proper lookout, failed to keep a safe speed, failed to yield the right-of-way, failed to maintain a safe distance and drove inattentively.

In her complaint, Mack seeks damages in an amount within the jurisdicational limits of the court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.
