A Hamilton County man is suing over claims his insurance company has failed to pay for a collision with an under insured driver that rendered the man disabled.

William Bates filed a lawsuit Oct. 17 in the Galveston County District Court against Protective Insurance Company, citing negligence.

According to the complaint, Bates was injured in a collision on Link Road in League City on Sept. 6, 2011, when under insured driver Philip Gentry failed to yield right of way while turning eastbound onto Link Road from Calder Road.

Bates says he sustained injuries rendering him permanently disabled and unable to work, evidence of which he provided to the defendant in the form of the testimony of a surgeon involved in his treatment.

The complaint states Bates was insured against under insured drivers under his policy with Protective Insurance, but the defendant ignored Bates' inquiries into payment and has failed to abide by the contract to pay the amounts owed. Protective Insurance Company is accused of negligence and gross negligence.

Bates seeks more than $1 million in contractual and consequential damages, damages including medical expenses, lost wages and loss of earning capacity, interest and attorney fees.
