Driver takes couple to court over rear-end collision

A Galveston County resident is suing a couple for alleged vehicular negligence in a 2013 crash allegedly resulting in property damage and physical injuries.

Michael James Moniz of Friendswood filed a complaint against Maret Elizabeth Moran and Sean Moran, both also of Friendswood, in Galveston County District Court on July 17, claiming several counts of negligence in a November 2013 roadway accident.

According to the suit, the plaintiff was traveling eastbound in the 1300 block of West Parkwood Avenue in Friendswood on or about Nov. 8, 2013 when a vehicle owned by Sean Moran and driven by Maret Moran suddenly rear-ended the plaintiff’s vehicle.

Moniz maintains physical injuries causing pain and suffering, mental anguish, disfigurement, lost earning capacity, and property damage.

The complaint states that Maret Moran failed to control her speed, keep a proper lookout and safe distance from the plaintiff, pay attention, reduce her speed, take evasive action to avoid collision, and brake accordingly. Moniz charges the couple with three counts of negligence plus negligent entrustment

The plaintiff seeks between $100,000 and $500,000 in compensation for damages, pre- and post-judgment interest, attorney’s fees, expenses, and costs. The plaintiff is represented by Robert Kwok, William Hoke, Christine Vinh Weems, and Alex Boylhart of Kwok Daniel Ltd in Houston.
