Negotiating firm sued over allegedly unpaid bills

A company that was hired by another firm to negotiate claims on several properties is asking the court to make that firm finally pay up.

Morrison and Morrison Inc. filed July 21 in Galveston County District Court against United Commerce Centers, citing breach of contract.

According to the lawsuit, on Jan. 14, 2013, Morrison and Morrison and UCC entered into a contract; Morrison and Morrison would investigate, inspect, negotiate and adjust for UCC the insurance claim for property at 10679 Harry Hines Blvd., Dallas.

Since Morrison and Morrison has devoted so much time and resources, it alleges that UCC is required to pay it 10 percent of the settlement for the loss of the property, the lawsuit states. That means Morrison and Morrison is allegedly owed $250,000 from UCC.

A second contract the two companies entered into on May 19, 2014, had Morrison and Morrison again arranging the claim for 12 more properties around Texas and adjoining states, the lawsuit states.

Morrison and Morrison believes it is owed several million dollars for claims associated with these properties -- $500,000 in all when the first contract is considered, which includes sales tax allegedly owed of $180,000.

The plaintiff seeks damages of more than $500,000, plus all unpaid sums, taxes, and expenses, which include court costs and attorneys' fees. The plaintiff is represented by C. Jake Posey of the Posey Law Firm PC in Austin.
