Woman sues Best Western for alleged rat bite

An alleged rat problem at a Galveston hotel is the subject of a Harris County woman’s lawsuit.

Grace Tobin filed the personal injury lawsuit against Sky Light Equity Holdings, Inc. on Aug. 5 in the Galveston County 212th District Court, claiming she “was bitten and scratched by a rodent on her left wrist” while staying at the Best Western Plus Seawall Inn & Suites on Aug. 13, 2013.

The suit says Tobin sustained serious and disabling personal injuries that have required extensive medical treatment following the incident in question.

“The plaintiff’s injuries were directly and proximately caused by the defendant’s negligence, and the way in which the plaintiff was injured was reasonably foreseeable,” according to the original petition.

Tobin additionally accuses the respondent of the following:

• In creating a dangerous condition at the Defendant’s premises;

• In failing to properly maintain the facility in a safe condition suitable for the ordinary use of invitees;

• In failing to exercise reasonable care to reduce or to eliminate a condition dangerous to invitees on the premises;

• In failing to exercise reasonable care to avoid a foreseeable risk of injury to Plaintiff and other invitees;

• In failing to properly train and supervise its employees so as to avoid unreasonable risk of harm to invitees through accidents such as the one giving rise to this cause of action;

• In failing to provide a safe environment for invitees;

• In failing to give adequate warning to invitees;

• In failing to reasonably inspect the premises and follow policy and procedures with regard to looking for signs of any rodent activity; and

• In failing to hire and make reasonable and necessary compensation to a professional pest control company to manage their pest control program.

Tobin insists she did not contribute to the purported event.

Consequently, she seeks unspecified monetary damages and a jury trial.
