A Harris County combustion engine company is suing another combustion engine business, two of its managers and an engine manufacturer following the purchase of allegedly faulty combustion engines.

Cypress Engine Accessories, filed a civil action lawsuit Aug. 4 in the Houston Division of the Southern District of Texas against HDMS Limited Company, doing business as Premium Power Solutions, George Robert Erickson and David C. Davis (managers of the former and Powertech-Marine Inc. ), alleging deceptive trade practices and breach of warranty.

According to the complaint, in late 2013, Erickson pitched a "two-piece pre-chamber" device to Cypress Engine in its Harris County business premises, after which the plaintiff purchased and sold a large quantity of the devices. The devices, the suit says, began to fail after they were sold and installed in customers' engines.

Initially, the defendants alleged the failures were due to the plaintiff's faulty installation of the devices, resulting in Cypress spending time, money, and effort replacing the faulty devices. A member of the defendant's staff then advised Cypress in spring 2014 that the devices were indeed faulty due to their manufacturing rather than installation failures, but the defendants did not recall the remaining devices and refund the purchase price, according to the suit.

Cypress Engines Accessories seeks more than $450,000 in damages, plus attorney fees and court costs. It is is represented by attorney D. John Leger of Leger & Burke in Houston.
