Discovery starts in collision suit against Port Arthur

Discovery has begun in an automobile collision suit against the city of Port Arthur over a wreck that occurred more than a year ago.

As previously reported, Peggy Louis Mitchell filed suit against the city on April 27 in Jefferson County District Court.

The latest filing in the case came on Aug. 12, a certificate of discovery showing that Mitchell served the city with her requests for disclosure and production and interrogatories.

According to the lawsuit, on Sept. 9, 2013, Mitchell was involved in a collision with a vehicle owned by the city.

The suit does not give details on how the collision occurred, but does accuse the city of negligent entrustment.

“Defendant City of Port Arthur, Texas, entrusted the vehicle to Sophia Raney Louis, a reckless and incompetent driver,” the suit states.

Some of the listed acts of negligence allege the driver failed to drive in a single lane, failed to yield and failed to enter an intersection when safe.

The plaintiff is suing for her past and future mental anguish, pain, medical expenses, lost wages and impairment.
