A motorist is suing his insurance company, alleging it did not cover damages for an accident.

Rocky Sealy filed a lawsuit June 12 in Galveston County District Court against USAA Casualty Insurance Company.

According to the complaint on Nov. 30, 2013, Sealy was driving on Interstate Highway 45 near Texas City when he was struck by a vehicle operated by Charles Lee Flores. The suit says the plaintiff's insurance policy, issued by the defendant, provided uninsured motorist coverage. However, the plaintiff's damages as a result of the collision left no money for such coverage, the suit says.

The suit says at the time of the collision, Sealy was insured by a written policy issued USAA Casualty, which the plaintiff says was either uninsured or underinsured. As part of the claim, Sealy further seeks the actual name of the insurance company that underwrote the policy.

Sealy seeks a jury trial, damages between $100,000 and $200,000, as well as court costs and attorney fees. He is represented by attorney Clyde J. Jackson III of Abraham, Watkins, Nichols, Sorrels, Agosto & Friend in Houston.
