TriState CareFlight accuses patient of pocketing insurance payout

A medical transport company is suing because it claims a patient did not fully reimburse it for its helicopter services.

TriState CareFlight filed a suit against Lyn Hailey on June 19 in Galveston County District Court, citing breach of contract and unjust enrichment.

According to the complaint, TriState CareFlight, based in Arizona, provided emergency medical transport to Hailey of Tiki Island, Texas on Jan. 1. The plaintiff claims the defendant signed a contract that she would remit to the plaintiff any payments she received from the health insurance company.

The plaintiff billed the insurer, Blue Cross Blue Shield, $45,096.96 for the medical services, and Blue Cross sent a check for that amount to the defendant. On April 12, she sent a check to the plaintiff for $25,000. The plaintiff claims the defendant refuses to remit the remaining $20,096.96 and she pocketed the money instead.

The plaintiff is charging both breach of contract and unjust enrichment. They seek damages of the principal amount, attorney's fees and court costs
