Venezuela company sues Texas business, alleging non-delivery of equipment

A Venezuela company is suing a Texas business, alleging breach of contract, violating the Texas Deceptive Trade Practices Act and fraudulent inducement.

Versapetrol filed the lawsuit June 22 in the Houston Division of the Southern District of Texas against Accurate Control Co. of Houston.

According to the lawsuit, the defendant entered into a contract to provide electrical equipment to Versapetrol in 2012 but the plaintiff never received the equipment.

The suit says the company has traded communications with Accurate Control and waited three years for the items, a delay that reflects negatively on them.

Versapetrol seeks return of all moneys paid to Accurate Control, the difference between the contracted price and the plaintiff's cost to cover the purchase from other sources, attorney fees, court costs, damages and a jury trial. It is represented by attorneys Greg Waller, Kelly Sandill and Luisa E. Muskus of Andrews Kurth in  Houston.
