Nederland McDonalds denied summary judgment in $1M slip & fall suit

A Beaumont judge has denied a motion for summary judgment in a lawsuit brought against a Nederland McDonalds.

Seeking up to $1 million in damages, plaintiff Sandra Bailey filed suit against R.E.E. Inc., doing business as McDonalds, in Jefferson County District Court.

According to the plaintiff’s first amended petition, which was filed on Feb. 19, on Oct. 3, 2012, Bailey was a customer at the McDonalds on Nederland Avenue when she slipped and fell because of water on the floor.

She accuses the defendant of negligently failing to inspect and maintain its premises and failing to place warning signs or safety mats near the dangerous condition.

Court records show that on Aug. 14 McDonalds filed a motion for summary judgment, arguing that the plaintiff’s claims are barred by statute of limitations.

The defendant argued the petition needed to be filed before or on Oct. 3, 2014.

A hearing on the matter was held Sept. 8 in Judge Kent Walston’s 58th District Court.

According to a courthouse official, Walston denied all motions for summary judgment.

The Houston law firm Daw & Raw represents the defendant.

Beaumont attorney Jonathan Juhan represents the plaintiff.
