Texas driver blames engineering employee for car collision

A Texas resident is suing an Oklahoma-based engineering firm and one of its employees, alleging they caused severe injuries he sustained in a car accident.

Jerrod Flusche filed a lawsuit Aug. 27 in the Sherman Division of the Eastern District of Texas against Standard Testing & Engineering in Oklahoma City and Danny Mathis, alleging negligence.

According to the complaint, on Sept. 4, 2013, Flusche was driving westbound on state Highway 32 near its intersection with Putman Road in Marietta, Okla., when Mathis, who was traveling eastbound, caused a collision when he turned left in front of Flusche's vehicle.

The suit faults Mathis with failing to maintain a proper lookout, making an unsafe left hand turn, not yielding right of way to Flusche's vehicle and failing to apply his brakes in a timely manner. The lawsuit states STE also is responsible for causing this collision as Mathis was acting within the course and scope of his employment for STE.

The plaintiff alleges he has and will continue to endure physical pain, mental anguish, disfigurement, physical impairment, medical expenses, lost income and loss of earning capacity.

Flusche seeks more than $75,000 in damages, plus court costs and other relief deemed appropriate by the court. He is represented by attorneys Edwin E. Wright III and Larry Sullivant of Sullivant, Wright & Brinkley in Gainesville, Texas.
