Medical biller didn't receive overtime pay from Surgical Monitoring Services, lawsuit alleges

HOUSTON – A Houston woman is suing her employer over claims of non-payment of overtime wages.

Cynthia L. Gaskin filed the suit Sept. 23 in the Houston Division of the Southern District of Texas against Foundation Ancillary Services Affiliate LLC, individually and doing business as Surgical Monitoring Services, citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff began working in the defendant's billing department, located in Houston, in March 2011. Through September 2014, she was paid an hourly rate and regularly worked overtime with no overtime compensation. From September 1 through October 2014, she was given the title of billing office lead and placed on a salary schedule. But, the suit claims, that position was non-exempt, according to the FLSA. She continued to work overtime with unfair compensation, she says.

The plaintiff seeks the full amount of unpaid overtime compensation plus an amount equal to that as liquidation damages, attorneys' fees and court costs, interest and other relief the court deems appropriate.
