Lifeguard alleges Sweetwater Pools failed to pay overtime

HOUSTON — A Harris County woman is suing a swimming pool business, alleging she was never paid for overtime work.

Sara Alice Tucker, individually and on behalf of others similarly situated, filed a lawsuit Dec. 29 in the Houston Division of the Southern District of Texas against Sweetwater Pools, alleging violation of the Fair Labor Standards Act.

According to the complaint, Tucker was hired by Sweetwater from 2011 until 2015 as a lifeguard. Her regular work schedule demanded that she work overtime, for which she was legally deserving of time and a half of her regular salary, the suit says. 

Despite the legal obligation of the company, Tucker alleges she and her coworkers received overtime pay at a lower, and therefore illegal, rate than what they had earned. 

Tucker seeks compensation for all damages, including lost wages, overtime pay, lost opportunities and legal fees. She is represented by attorney Melissa Moore of Moore & Associates in Houston.
