Driver alleges Kia Motors vehicles not reasonably crashworthy

MARSHALL – A Tyler woman is suing Kia Motors, alleging one of its vehicles was not crashworthy, leading to serious injuries to her child.

Norma Blas, on behalf of her minor child, filed a lawsuit on Dec. 14 against Kia Motors America, Inc. and Kia Motors Corp. in the Marshall Division of the Eastern District of Texas, alleging negligence.

According to the complaint, on May 21, Blas was driving a 2005 Kia Spectra and while stopped, another vehicle struck her car causing her to strike a third vehicle. At the time of the crash, the suit says, her child was properly seated and wearing her seatbelt. 

Despite being restrained, the child was seriously injured because, according to the lawsuit, the Kia Spectra was not reasonably crashworthy and not reasonably fit for unintended and any foreseeable accidents. 

Blas seeks actual damages, prejudgment and post-judgment interest beginning May 21, plus costs of the lawsuit. She is represented by attorneys E. Todd Tracy, Stewart D. Mathews and Andrew G. Counts of The Tracy Firm in Dallas.
