Japanese insurance company alleges ship's owners to blame for cargo damage

HOUSTON – A Tokyo-based insurance company is claiming a cargo vessel en route from Shanghai to Houston damaged some stainless steel piping, which resulted in more than $369,000 worth of damage. 

Mitsui Sumitomo Insurance filed a lawsuit on Jan. 7 against the moving vessel Defiant in the Houston Division of the Southern District of Texas alleging breach of contract.

On Nov. 12, 2014, the the owners of the Defiant agreed to safely deliver stainless steel, seamless pipe from Shanghai to Houston. On Jan. 8 2015, when the Defiant arrived Houston, according to the lawsuit, much of the cargo was either dented, bent, nicked, flattened or otherwise physically damaged.

The damage of the cargo, according to the lawsuit, resulted in breach of contract, negligence and breach of bailment.

Mitsui, who is seeking $369,200 in damages, plus interest dating from Nov. 12, 2014, is being represented by attorney Robert C. Oliver of Houston.
