HOUSTON – A former merchandise manager at a shoe company in Houston claims he was fired because he is Mexican.

Hector McDonald filed a lawsuit Dec. 30 against DSW Inc. in the Houston Division of the Southern District of Texas alleging a violation of the Civil Rights Act of 1964.

McDonald was employed at Designer Shoe Warehouse at various locations in Texas from approximately 2008 to 2013, the complaint states. On or about Oct. 29, 2013, he alleges he was fired for allegedly violating the company’s apprehension policy.

He claims that he was aware of a black employee who was fired for the same violation, but that a white employee who also violated the company’s apprehension policy was not fired. Still, he made an appeal to the company’s regional human resources manager to no avail, the suit states. He alleges he was terminated because he is Hispanic.

McDonald seeks compensatory damages, attorney's fees, interest and punitive damages. He is represented by attorney Katrina Patrick of Houston.
