Trust fund trustee alleges Galveston County man owes $27,000 in unpaid rent

GALVESTON – The trustee of a children's trust fund is suing a renter, alleging default in a property lease.

Charles E. Lobb Jr., as trustee of the Jamail Children's Trust of 2010, filed the suit Feb. 3 in Galveston County District Court against James Lewis Harrison of Kemah. 

According to the complaint, on March 10, 2011, Lillian Jamail, trustee of the children's trust, entered into a commercial lease agreement as landlord with Clearlake & Galveston Shuttle Bus Inc. The bus company leased property at 2215 Gulf Freeway, La Marque.

The suit says the defendant executed the lease on behalf of Clearlake & Galveston Shuttle Bus Inc. and, in so doing, personally, irrevocably, absolutely and unconditionally guaranteed all terms and conditions of the lease including prompt payment of the rent.

The term of the lease was March 1, 2011, through March 31, 2016, the suit says.

The lawsuit says Harrison defaulted by failing to pay the required monthly rent and vacated the premises Aug. 1, 2015. As a result, the suit alleges, the landlord/plaintiff has been damaged for all rent not paid, an amount of $27,000.

Lobb seeks damages of $27,000, prejudgment and post-judgment interest, attorney fees and court costs. As an attorney-at-law, the plaintiff is representing himself.
