Ex-worker accuses NAPA Auto Parts of age discrimination

HOUSTON – A former human resources manager is suing NAPA, alleging she was fired because of her age.

Patricia Osborne, 63, of Harris County filed a lawsuit Jan. 25 in the Houston Division of the Southern District of Texas against Genuine Parts Company, doing business as NAPA Auto Parts alleging a violation of the Age Discrimination in Employment Act of 1967.

Osborne began working for NAPA on Nov. 1, 2011, the suit says, where she was employed before being fired April 30, 2015.  According to the complaint, she was forced to reveal to co-workers that she had breast cancer and was still able to receive a ``meets expectations” performance by NAPA in 2013.

Osborne alleges she received no verbal counseling or write-up during 2014 and 2015, and was nominated by her supervisor in February 2015 as an "HR Manager of the Year" award recipient. In April 1, 2015, she earned a raise and a $18,560 bonus.

However, after receiving her performance review April 30, 2015, the lawsuit states, the plaintiff was told by management later in that day she was not `` a good fit” for the company and she was terminated effective immediately.

Osborne seeks a jury trial as well as liquidated and punitive damages and attorney fees. She is represented by attorney April Walter of Starzyk and Associates PC of The Woodlands.
